COVID-19 AND INTELLECTUAL PROPERTY LAW: COMPULSORY LICENSING AND THE ACCESS TO COVID-19 TREATMENT

This essay concerns the problematic of access to Covid-19 treatment at an international scale and role Intellectual Property Law. As in past outbreaks, one most raised questions is possibility patent holder’s rights being obstacle treatment. Since beginning this pandemic, Compulsory Licensing has been presented as mechanism capable guaranteeing globally rapidly. We propose analyse figure its possible alternatives - Voluntary Licensing, Patent Pools Proposal waive TRIPS provision. will then assess which effective solution overcome humanitarian crisis without compromising balance between right health intellectual property rights.
